Ben Melham has applied to have his hearing of betting-related charges heard behind closed doors.
However Victorian Racing Tribunal chairperson Judge John Bowman said on Tuesday that he would need to be “persuaded” to agree to the request.
Melham will continue to be allowed to ride until the determination of the charges – with the hearing now set down for three days from September 21.
“Mr Melham indicated the ultimate hearing to be a closed hearing,” Judge Bowman said on Tuesday.
“Now, I’d want to be persuaded about that, I might say.
“I won’t make any ruling on that at the moment, but at some stage that will have to be determined.”
Melham was charged in May with allegedly placing thousands of dollars in bets, using an account that it’s alleged was operated by partner Karlie Dales, on races at Sandown, Geelong, Sunshine Coast and Singapore, between July and September 2019.
Seven charges relate to alleged bets last year totalling more than $21,000, including three bets allegedly made on horses that Melham rode.
None of the charges related to Melham betting against his own rides.
Melham faces a mandatory two-year ban if found guilty of placing the bets.
